Last Will and Testament of Elijah PAIN of Anne Arundel Co.,
Dated: 9 March 1829, Proved: 3 May 1836


In the name of God Amen, I Elijah Pain of Anne Arundel County, and State of Maryland, being in perfect health of body, and of sound disposing mind, memory and understanding, considering the certainty of death, and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be better prepared to leave the world when it shall please God to call me hence, do make and publish this my last Will and testament in manner and form following that is to say. First and principally, I submit my soul into hands of Almighty God, and my body to the Earth, to be decently buried, at the discretion of my Executor, herein after named and after my debts and funeral charges are paid.

Item, I give and bequeath unto Mary T. Russell, and her heirs, all my real Estate forever, and all my household furniture -
Item, I give and bequeath to Henry Watts brother of my wife my family Bible, -
Item, I give and bequeath to Owen Disney my Saddle, bridle and great coat. -
Item, As to the residual of my personal estate, to be sold and fifty dollars to be given to Elizabeth Tucker, Mary's sister - And if there is any money left I give it to Rachel Barber the wife of Aquilla Barber -
Item, I give and bequeath unto Randolph Webb, son of James Webb, my gun, powder horn, and shot bag.-
Item, I give my common wearing apparel to be divided among such as may lay one out, and put on my burial clothing, likewise I do hereby Constitute, and appoint the aforesaid Mary T. Russell, Executrix of this my last Will and Testament.

In Testimony whereof, I have hereunto set my hand, and affix to my seal, this ninth day of March, in the year of our lord, one thousand eight hundred and twenty nine.- Item, I give and bequeath unto Mary T. Russell all my present crop, of whatever is, and may be made.-

Elijah Pain, the above named Testator, as and
for his last Will and Testament, in the presence of us, who at his request
in his presences, and in the presence of each other, have Subscribed our names, as witnesses thereunto.-

Then came John Pumphrey and Dennis Gaither, live of the subscribing The 3d day of May 1836. witnesses to the a foregoing last Will and Testament of Elijah Pain, late of Anne Arundel County deceased, and made oath on the Holy Evangely of Almighty God that they did see the testator therein named sign and seal this Will and that they heard him publish pronounce and declare the same to be his last Will and testament that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding, and that they together with Richard Donaldson the other subscribing witness (who is since dead) respectively subscribed their names as Witnesses to this Will in the presence and at the request of the testator and all in the presence of each other.-

Then came Mary T. Russell and made Oath on the Holy Evangely of The 3rd day of May 1836. Almighty God that the aforegoing Instrument of writing is the true whole and last Will and Testament of Elijah Pain, late of Anne Arundel County, deceased, that hath come to her hands and possession and that she doth not know of any other.
